These Terms of Service ("Terms") are a binding contract between you and Bandwagon, Inc. ("Bandwagon"). By using bandwagon.run or any related service, you agree to them.
We've tried to keep the language readable. The legal force is real either way.
Acceptance
By creating an account, posting content, pledging, voting, booking, sponsoring, or otherwise using Bandwagon, you accept these Terms, the /privacy policy, the /aup acceptable use policy, and any policies referenced here.
If you don't agree, don't use the service.
Eligibility & accounts
- You must be 13 or older to create an account.
- You must be 18 or older to make payments, hold a paid subscription, or operate a band/venue/vendor/sponsor account.
- You must be authorized to act on behalf of any band, venue, or business you represent.
- You agree to provide accurate information and keep it current.
- One person, one account. Bands, venues, and businesses get their own accounts separate from personal fan accounts.
- You're responsible for what happens under your login. Use a strong password and enable MFA.
- We can refuse, suspend, or terminate accounts at our discretion if they violate these Terms.
Account roles
Bandwagon has four roles, with different rights and obligations:
- Fan — free. You can vote, follow, pledge, buy merch, attend.
- Band — paid subscription ($9 / $29 / $79 per month tiers). You can list, sell merch, accept offers, invoice venues, receive payouts.
- Venue — free. You can post open slots, send offers to bands, sell tickets, file door reports, receive payouts.
- Brand sponsor — free signup, pay per sponsorship claimed. You can buy presenting/stage/bar/merch/VIP placements.

How you can and can't use Bandwagon
The full list lives in our Acceptable Use Policy. Highlights:
- You can post music, photos, videos, posts, reviews, messages, and merch listings that are yours (or that you have rights to use).
- You can't post content that infringes copyright, harasses, defrauds, impersonates, doxxes, or violates any applicable law.
- You can't automate the platform without our written consent (no bots, no scrapers).
- You can't use the platform to launder money, fund violence, or sell anything illegal.
- We can remove content and terminate accounts that violate the AUP, with or without notice depending on severity.
Your content & licenses
You retain all ownership of content you post — your music, photos, videos, posts. You give Bandwagon a non-exclusive, royalty-free, worldwide license to host, display, distribute, and transmit your content as needed to run the service. This license ends when you delete the content (subject to cached/backup copies that age out within 90 days).
You represent and warrant that you have the rights to anything you post — your own work or properly licensed third-party material. If a DMCA notice is filed against your content, we follow the process in /dmca.
Performance contracts (between bands and venues) and signed agreements (e-signed via /contracts) belong to the parties that signed them. We retain copies and audit logs for 7 years.
Bandwagon's role as intermediary
Bandwagon is a marketplace. We provide tools — discovery, voting, crowdfund escrow, messaging, contracts, payouts. We don't produce, perform, or guarantee the shows themselves. Bands and venues contract directly with each other.
Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), we're not liable for content posted by users. We do moderate per our AUP — content that violates the AUP gets removed regardless of who posted it.
Payments, crowdfund, refunds, fees
All money on Bandwagon flows through Stripe Connect. We never touch your funds directly. By using paid features you also agree to Stripe's Connected Account Agreement.
Crowdfund · all-or-nothing. When fans pledge to an event:
- Cards are authorized but not charged during the campaign.
- If the goal is met by the deadline: cards charge automatically, funds release to the band via Stripe Connect on a schedule we publish.
- If the goal is not met: no card is charged. No fee.
- If the event is cancelled after funding: pledges are refunded automatically. Bandwagon's 5% platform fee is refunded with them.
Other transactions. Merch sales, invoice payments, sponsor placements, and live-stream tickets are settled through Stripe Connect with platform fees disclosed at point of transaction.
Refunds. See our Refund Policy. TL;DR: failed crowdfunds and cancelled events get auto-refunds. Other disputes go through our mediation process in /admin → Refund disputes.
Platform fees are listed publicly on the landing page and at every transaction point. They can change with 30 days' notice; existing transactions are honored at the rate at time of transaction.
Band subscriptions
Bands choose a tier — Starter $9/mo, Touring $29/mo, Pro $79/mo. Founding 30 bands in the Daytona pilot get Touring free for 6 months, with auto-conversion to paid Touring unless cancelled before the 6-month mark (you'll get a heads-up email 14 days before).
- Billed monthly. Cancel any time — access continues through the end of your current period.
- No refunds for partial months unless we screwed something up.
- Downgrading: takes effect at the next billing cycle. Some features may become unavailable; existing data stays accessible.
- Pricing can change with 30 days' notice; existing subscriptions are grandfathered for 6 months.
Contracts between users
When you accept an offer, sign a performance agreement, or close any deal on Bandwagon, you're entering a contract with the other party — not with Bandwagon. Bandwagon provides the tools (templates, e-sign, escrow) but isn't a party to those agreements. Dispute resolution between users is handled per the terms of those contracts; we offer mediation through /admin → Refund disputesbut we aren't obligated to take sides.
Reviews
Three-way reviews (fan → event, venue → band, band → venue) are honest opinions, not facts. We don't edit reviews to flatter parties, and we won't remove reviews for being negative as long as they're truthful and non-abusive. We may remove reviews that violate the AUP (harassment, doxxing, fake reviews, off-topic).
Termination
You can close your account at any time via /settings → Delete account.
We can suspend or terminate your account if you:
- Violate these Terms or the AUP
- Fail to pay subscription fees after 14 days' notice
- Cause significant harm to other users or to the platform
- Are subject to a valid legal order requiring us to do so
If we terminate your account, you remain responsible for any outstanding obligations (unpaid invoices, in-flight refunds, contractual commitments to other users).
Disclaimers · no warranty
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or secure. We don't warrant that shows will happen, that bands will perform, that venues will pay, that crowdfund campaigns will succeed, or that any party will live up to their end of any contract.
Limitation of liability
To the maximum extent permitted by applicable law, Bandwagon's aggregate liability to you for any claim arising from or related to the service is limited to the greater of: (a) $100 USD, or (b) the total fees you paid to Bandwagon in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages — including lost profits, lost data, business interruption, or lost goodwill — even if advised of the possibility.
Indemnification
You agree to indemnify and hold Bandwagon, its officers, employees, and agents harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the service, your content, your breach of these Terms, or your violation of any law or third-party rights.
Dispute resolution · arbitration
Informal first. Email legal@bandwagon.runand we'll try to resolve it informally within 60 days.
Binding arbitration. If informal resolution fails, disputes between you and Bandwagon are resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration takes place in Volusia County, Florida, unless we mutually agree otherwise. Each party pays their own fees up to the AAA caps.
Class action waiver. You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class or representative action.
Small claims exception. Either party can bring claims in small claims court in Volusia County in lieu of arbitration if they qualify.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The federal and state courts located in Volusia County, Florida have exclusive jurisdiction over any non-arbitrable claim.
Changes to these Terms
We may update these Terms. Material changes get email notice 30 days before they take effect; minor changes take effect when posted. Continued use of Bandwagon after the effective date constitutes acceptance.
